A FATHER-of-two has been jailed for 16 months after he sexually assaulted a woman in her home - ignoring her saying "no" a total of 37 times.

Benjamin Hayes, 31, entered the married woman's home as she was getting ready for work and tried to "coerce" her into having sex.

He picked up the woman in a "bear hug" and carried her into a spare bedroom where he "straddled" and "dry-humped" her.

Hayes, a plumber, then attempted to kiss her in an intimate area - ignoring her repeatedly saying no 37 times, which was caught on a home security camera.

He was charged with attempted rape and sexual assault and tried by a jury at Bristol Crown Court, who found him guilty of sexual assault and not guilty of attempted rape.

Judge, Mr Recorder James Watson, jailed Hayes for 16 months on Thursday (September 19), and ordered he be placed on the Sex Offenders Register for 10 years.

The court heard that it was around 7.30am on July 18 last year when Hayes entered the woman's house.

The whole assault was caught on a home security camera, and played to the court during the trial last month.

Hayes did stop and left the house after the woman became increasingly angry and forceful against him.

When he was gone she carried on getting ready in shock and went to work where she broke down and told her husband and then reported the incident to the police.

Representing Hayes, Mrs Emma Martin asked the judge to consider a suspended sentence.

She said Hayes was of previous "good character", and that he is the bread winner of a family with two small children.

Mr Recorder J Watson said: "The assault was preceded by an attempt on your part to pursue full sexual intercourse with her.

"When that did not work you pushed her into the spare bedroom and assaulted her.

"You said you had reasonable belief she might want to have sex with you but the jury rejected that case.

"And it is crystal clear from the audio she did not want to. That should have been it, if you had stopped then, you would not be standing in court now.

"You even described your actions as 'trying your luck' and 'mucking about' - this reveals to me your perspective on the events.

"I make it clear, that you have a wholly distorted way of looking at it which shows you have not faced up to the seriousness of events.

"I find it difficult to give you credit for stopping of your own volition given you had overridden so many of her rejections.

"You stopped because you knew that to have continued on it would have been attempted rape," he added.

"The long lasting impact your actions will have on the victim's psyche, level of confidence and sense of vulnerability will likely be endured long into the future.

"Especially because of the way in which you invaded her privacy in the upstairs bedroom of her home. What she referred to as the 'sanctuary of her home'.

"A man who carries out sexual violence and does so with the aim of achieving full intercourse must accept a custodial sentence.

"To do so as I described, in her own home, would in my judgement make it inappropriate to suspend the sentence."

Hayes, from Weston-super-Mare, was handed a 16 month jail sentence and was told he would serve half his sentence in prison and the remainder on licence.

He will be placed on the Sex Offenders Register for 10 years and was ordered to pay a victim surcharge of £140.
