THIS motorist was travelling well within the speed limit on the M5 - but they could still face prosecution.

Police have issued the driver with a Traffic Offence Report (TOR) for hogging the middle lane of the motorway while travelling southbound.

Officers took the action yesterday lunchtime (Wednesday, January 19) as there were no vehicles in lane one at the time.

The reason for the TOR being given is that driving in such a manner reduces road capacity, leading to increased congestion and inconveniencing other motorists.

A spokesperson for Avon and Somerset Police's roads policing unit said on social media: "A bugbear for many...Vehicle seen travelling M5 South, Lane 2, 64mph. Nothing in Lane 1.

"This driving behaviour reduces road capacity, increases congestion and inconveniences others.

"TOR issued, driving without due care and attention."

TORs are issued when a police officer believes a driver may have committed a specified road traffic-related offence(s) on a particular occasion and considers further action is appropriate.

The offence can be dealt with by way of advise, although other options include a diversionary course, fixed penalty or prosecution depending on the seriousness and recommended guidelines.
